The firm is a year old and comprised of five experienced biglaw corporate and litigation attorneys. As we begin to take on employment matters, we are seeking an Of Counsel – Employment Law attorney to support such work on a part-time, remote basis.
This role is ideal for a senior attorney who values a flexible schedule and the ability to manage their own workflow, while still engaging in sophisticated legal work for a diverse set of business clients. The initial workload would be light but grow in line with the firm’s continued growth into year two.
Position Summary
The Of Counsel – Employment Law attorney will handle a variety of employment advisory and drafting matters. The attorney will largely be able to set and manage their preferred working hours, and the firm works with clients to maintain reasonable and predictable timelines. Compensation is based on a competitive take-home rate tied to hours billed to clients.
Key Responsibilities
- Draft, revise, and update employment policies, employee handbooks, and HR compliance documents.
- Structure and prepare ESOPs, equity incentive plans, option grant documents, and related corporate materials.
- Advise clients on:
- Hiring and termination practices
- FLSA and state wage-and-hour compliance
- Employee vs. contractor classification
- Leave laws, accommodations, and workplace procedures
- Anti-discrimination, anti-harassment, and compliance requirements
- Disciplinary issues, performance management, and internal investigations
- Assist with employee dispute matters, including pre-litigation strategy and responding to agency inquiries or demand letters.
- Draft and review employment agreements, contractor agreements, confidentiality agreements, and separation agreements.
- Provide guidance on federal, state, and local labor regulations.
- Coordinate with the firm’s corporate team on employment related aspects of business transactions and expansions.
Qualifications
- J.D. and active membership in at least one U.S. state bar; preference for California qualification.
- 5+ years of employment law experience in a law firm or in-house setting.
- Deep familiarity with federal and state employment laws, including significant drafting and advisory experience.
- Excellent written and analytical communication skills.
- Ability to work independently, manage timelines, and communicate clearly with clients.
- Experience with early-stage companies is a plus but not required.

- Remote, part-time Of Counsel (independent contractor) role.
- Competitive take-home rate based on hours billed to firm clients.
- Flexibility to choose preferred working hours; assignments are structured with realistic turnaround expectations.
- Minimal unscheduled calls or urgent requests.
